Client-paid model

The principal/client pays the applicable NotarioPH platform and transaction charges directly through NotarioPH.

NotarioPH should clearly distinguish:

1. NotarioPH Platform Fees — Fees charged for use of the electronic notarization platform and related technology services.
2. ENP Professional/Notarial Fees — Fees determined by the ENP for the professional notarial service.

Secure Videoconferencing

NotarioPH supports the applicable electronic notarization workflow, including remote electronic notarization where permitted.

NotarioPH maintains transaction-related records necessary to establish the sequence and integrity of the electronic notarization process.

NotarioPH provides secure storage of electronic notarization records according to the applicable service plan and retention requirements.

Reporting and Compliance

NotarioPH is designed to support ENP compliance and applicable reporting requirements.

The Supreme Court's current FAQ states that, before the Supreme Court Central Notarial Database becomes operational, ENPs have monthly reporting obligations involving certified electronic copies of the Electronic Notarial Book and corresponding notarized documents. Once the Central Notarial Database becomes operational, transmission from the ENF is expected to become automatic.

An ENP may discontinue use of NotarioPH subject to the applicable NotarioPH Terms and Conditions.

NotarioPH's record-transfer process should provide for the secure export or transfer of records that the ENP is legally entitled or required to retain.

Recommended NotarioPH exit process

1. ENP submits a record-transfer request.
2. NotarioPH verifies the ENP's identity and authority.
3. NotarioPH identifies the records covered by the request.
4. Records are exported in an appropriate electronic format.
5. NotarioPH provides the records securely to the ENP or authorized recipient.

NotarioPH maintains records only for the period required by law, regulation, contractual obligations, or its applicable retention policy.

NotarioPH should not represent that all records can simply be deleted upon cancellation, because ENPs have continuing record-retention obligations.

The Supreme Court states that ENPs must retain copies of electronically notarized documents for the duration of their commission unless a court orders a longer retention period, and must retain a duplicate copy of the Electronic Notarial Book until expiration of the commission.
